CDL’s
The Herrington Law Office understands that you depend on your commercial drivers license to earn your living.
As a professional driver, you know that you can be disqualified from driving your commercial motor vehicle for 60 days if convicted of two serious traffic violations within a three–year period, and for 120 days if convicted of three serious traffic violations within a three–year period.
Also important to CDL drivers is the Texas Code of Criminal Procedure, which provides: “if a person holds a commercial driver license either at the time of the offense or at the time of sentencing,” he is not eligible for either deferred adjudication or a driver safety course. See Article 45.051 (Deferred Adjudication / Deferment) & Article 45.0511 (Driver Safety Course), Texas Code of Criminal Procedure.
That leaves the CDL holder with two choices: pay the ticket, which we would advise against, or go to trial with an experienced trial lawyer. Call the Herrington Law Office to discuss your CDL case.
